The New Jersey Service Worker Retention Law
As of October 24, 2023, Service Worker Retention is now NJ State Law.
On July 23, 2023, Governor Murphy signed into law new legislation, the Service Worker Retention Law, that requires specific actions by the “awarding authority” and the incoming successor contractor so that incumbent Service Workers are offered continued employment when there is a building ownership or contractor change.
If you are a covered company and employ Service Workers or contract out this work, failure to take these actions subjects you to liability for significant fines, back pay and other remedies. These provisions apply to contracts entered into or renewed on or after October 24, 2023.
